What Is a Podcast Interview Consent Form and Why Do You Need One?

A podcast interview consent form — also called a podcast guest release form — is a written agreement between a podcast host and their guest documenting consent to record, edit, publish, and distribute the interview. Unlike a generic interview consent form, a podcast-specific form also covers syndication rights, clip reuse, transcript publication, and the platforms (Spotify, Apple Podcasts, YouTube, social media) where the content may appear.

Every podcast host should use a consent form before recording each episode. Once published across streaming platforms, an episode becomes permanently associated with the guest's voice and likeness. A podcast interview consent form protects the host from content removal requests and protects the guest by documenting what they agreed to. For episodes that will be audio or video recorded, the consent form also satisfies two-party consent recording laws that apply in many US states.

Many podcast interviews are conducted remotely over Zoom or Skype. In these cases, an online interview consent form sent via email before recording is widely accepted as legally valid. For video podcast episodes published on YouTube, a video interview consent form that explicitly covers video rights and thumbnail usage is also recommended.

Podcast hosts who produce documentary-style content should consider a media interview consent form which includes broadcast and theatrical distribution rights. For journalistic podcasts, a journalism interview consent form may be more appropriate as it includes on-record versus off-record attribution clauses. See our guide on how to write an interview consent form and browse interview consent form samples and examples for real-world formats.

What to Include in a Podcast Interview Consent Form

  • Podcast name, host name, and production companyIdentify who is producing the episode and under what production entity or brand.
  • Guest name and contact informationFull legal name and email address of the guest — essential for any post-publication communication.
  • Recording consent — audio and/or videoSpecify whether the session will be audio recorded, video recorded, or screen recorded. Two-party consent laws require explicit permission before recording in many jurisdictions.
  • Publishing rights — all platforms coveredList every platform where the episode may appear: Spotify, Apple Podcasts, Amazon Music, YouTube, podcast website, and social media clips. Missing a platform means you technically lack permission to publish there.
  • Editing consentConfirm the host's right to edit for length, clarity, and audio quality, and specify whether the guest can review the episode before release.
  • Syndication and clip repurposing rightsCover reuse of quotes and audio/video clips in newsletters, social media posts, YouTube Shorts, promotional trailers, and future compilation episodes.
  • Episode topic and expected publication dateState the planned episode topic and approximate publication window so the guest knows when to expect their episode to go live.
  • Any content restrictionsDocument any topics, statements, or portions of the interview that the guest has requested not be published or used in clips.
  • Compensation or promotional arrangementIf the guest is being paid an appearance fee, or if the host has agreed to promote the guest's work, document this in the form.
  • Signature lines for host and guestBoth parties should sign. For remote recording sessions, an email-based consent form sent and replied to in writing constitutes valid consent in most jurisdictions.

Podcast Recording Laws — Know Before You Record

  • Reporters Committee — State-by-State Recording Law Guide — covers which US states require one-party vs two-party consent for recording conversations.
  • Always send your podcast interview consent form before the recording session begins — consent obtained after recording starts may not be valid in all jurisdictions.
  • For international guests, check the recording consent laws in their country — the UK, Canada, Australia, and the EU all have specific rules on recording consent.
